Pivovarova N.P. Refused to Issue Health Record Extracts

We can provide extracts only with the mother’s consent (!?)

REJECTION from the Administration of the Health Care Institution “City Children’s Clinic No. 13” to provide me with Health Record EXTRACTS of my Children. The application was submitted on July 02, 2020, by my attorney, Mr. A.K.

The administration of the Health Care Institution “City Children’s Clinic No. 13” has considered your application of July 02, 2020.

“Hereby we inform you of the following: due to the fact that the legal representative of A.C., born on April 01, 2015, is her mother (Liudmila Trafimovich), we can provide the extract from the child’s medical records only with the mother’s consent”(!?).

According to Article 20, Clause 1 of Law of the Republic of Belarus No. 300-З of July 18, 2011, “On Appeals of Citizens and Legal Entities”, the decision of the administration of the clinic may be appealed to the Health Committee of the Minsk City Executive Committee in the manner established by the law.

Despite the fact that my Attorney, Mr. A.K., followed all requested rules by the Health Executive Committee to receive information regarding the health status of my children, I was refused with the argument that it can only be provided with the mother’s consent, Ms. Liudmila Trafimovich! As you all understand, I am denied having any information regarding my children, although Ms. Trafimovich endangers their health and well-being!

“Custody and guardianship determined for minor Belarusian citizens while complying with the laws of the respective states are recognized effective in the Republic of Belarus if there are no objections against the determination of custody and guardianship or against their recognition from a diplomatic mission or a consular agency of the Republic of Belarus, which should receive a competent opinion of the Ministry of Education of the Republic of Belarus in the manner prescribed by the Government of the Republic of Belarus”.

Pivovarova grossly violated Part 1 of Article 46 of Law of the Republic of Belarus dated June 18, 1993, No. 2435-XII “On Health Care”, according to which information about the patient’s health status is provided by the attending physician to the patient or to the persons specified in Part 2 of Article 18 of the Law, including the parent (legal representative).
