Although Belarus is a Contracting State, thus blatantly violating International Law, the parental and paternal rights of Mr. Nicolaos Cheropoulos and the human rights of the children and the father.<\/p><p style=\"padding-left: 40px\"># In fact, the father exhausted all legal remedies and even reached the Supreme Court of Belarus without finally being acquitted. Trafimovich sued the father in the Belarusian courts regarding the custody of the children, determination of their place of residence, payment of alimony by the father, and resolution of a different procedure for the transfer of minor children outside the Republic of Belarus.<\/p><p style=\"padding-left: 40px\">#The Court upheld the claims of L.A. Trafimovich with the decision dated December 27, 2018, in the absence of the father, who then appealed the decision for a second time, requesting its annulment, as the ruled decision was illegal for the following reasons:<\/p><p style=\"padding-left: 40px\">#The father, a resident of Sweden, was not legally and duly notified of the hearing on December 27, 2018. Consequently, he was not informed about the case discussion as required by Article 15 of the Convention on 15\/11\/1965 on Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters. Therefore, he was not present or represented by a lawyer.<\/p><p style=\"padding-left: 40px\">#The issued decision was illegal as it did not fall within the jurisdiction of the Court of Justice of the Republic of Belarus.
