Early in June 2018, I started to work with the Law Firm Arzinger in Minsk. The day I undersigned the contract, I met the members of the Legal Team, which consists of Mr. Alexander Korsak (Managing Partner), Ms. Elena Mashonskaya (Partner), Ms. Tamara Nesterovich (Legal Assistant), and Ms. Julia Mironchik (Attorney).<\/strong><\/em><\/p>\n\n\n\n

The first question Mr. Korsak addressed to me was: \u201cWhat do you expect from us?\u201d I answered him that I did not expect any miracles, but I expected that they would do their best. I remember this question as it was yesterday, and I felt a special connection to Mr. Korsak from that moment and on.<\/em><\/strong><\/p>\n\n\n\n

Ms. Mashonskaya and Ms. Tamara Nesterovich (who speaks the English language and helped me communicate with Ms.  Mashonskaya) represented me in the courtrooms of Belarus.<\/p>\n\n\n\n

My Greek lawyer, Ms. Poni, and I communicated mainly with Ms. Nesterovich and with Mr. Korsak, who speaks English perfectly.<\/p>\n\n\n\n

I felt secure and safe with this legal team. They were well-organized, effective, and creative! Their cross-border cooperation with Ms. Poni in Greece went smoothly.<\/em><\/strong><\/p>\n\n\n\n

Ms. Mashonskaya did her best to protect the interests of my children and of me as a left-behind parent every time we met in the courtrooms of Belarus. She is also a great negotiator and always smiling. Ms. Mashonskaya is definitely not someone who will sit down when a Judge gives her a nasty look.<\/strong><\/em><\/p>\n\n\n\n

Thus, something happened at the end of 2018 and the beginning of 2019. Ms. Poni and I started to feel a decline in the follow-up of my case. Ms. Poni reminded them and asked them several times about the deadline regarding my Hague Case, which we did not want to miss for any reason, but we kept receiving answers that everything was \u201cunder control\u201d!<\/strong><\/em><\/p>\n\n\n\n

In April 2019, when I was in Minsk in an attempt to celebrate my youngest daughter\u2019s birthday, I was informed that Mr. Korsak and Ms. Elena Mashonskaya would work separately for a while. I did not feel good about it, but I had no other choice than to accept it.<\/p>\n\n\n\n

The follow-up of my case started to get even worse,<\/em> and in September, we were informed that we missed the deadline to appeal regarding my Hague Case! The exact same deadline that Ms. Poni reminded them of several times long before!<\/em><\/strong><\/p>\n\n\n\n

Because I know Ms. Elena Mashonskaya\u2019s skills, competence, and performance, it is very difficult for me to accept that she missed the deadline because of a mistake or lack of knowledge.<\/p>\n\n\n\n

I believe that the following Citations from an article explain a lot:<\/strong><\/em><\/p>\n\n\n\n

\u201cI was even surprised when the Justice Ministry\u2019s checks began against me (three checks in six months) when they accused me of telling the media that I had not been allowed to visit my client Nyaklyaeu for several days. I was deprived of a license on a formal occasion. For some time, I thought (it was not a naive faith, but the faith of a lawyer) that the court would figure it out because twice two is always four. However, this did not happen.\u201d<\/em><\/p>\n\n\n\n

\u201cThe essence of the work of a lawyer is to represent the interests of his client in accordance with the law and the rules of lawyer ethics, and not \u201crecommendations\u201d and the requirements of colleagues or authorities. I had a choice: to work independently, as it should be for a lawyer, but at the same time risk my professional future, or be guided by the \u201cadvice\u201d of the board and authorities, contrary to legal obligations and ethical standards.\u201d<\/strong><\/em><\/p>\n\n\n\n

\u201cIn practice, the decision to do my job properly for me meant a forced change of three jobs. They demanded that I did not disclose unprecedented violations of the law in relation to clients and to stop actively defending their rights. When I was forbidden to leave the territory of Belarus<\/a> because of \u201cevading draft measures,\u201d the lawyer community, in spite of my calls to protect me from illegal pressure, took no action. They repeatedly made it clear to me that at least I would not be allowed to continue the practice of law. Therefore, I was forced to consider the option of continuing my studies.\u201d<\/em><\/strong><\/p>\n\n\n\n

At the end of 2019, we were also informed that attorney Mr. Korsak would not work together with Ms. Elena Mashonskaya anymore. This was sad news because they were a great team together, the best professionals I ever met in Minsk.<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n

Ms. Elena Mashonskaya is one of the very few in Belarus, perhaps the only one with extended experience regarding \u201cThe Hague Convention\u201d and Child Abduction. <\/strong><\/em><\/p>\n<\/blockquote>\n\n\n\n
