That response clarified the limits of EU competence and returned the relevant responsibility to the national legal sphere. The accountability gap identified in this brief is an independent governance analysis of what may occur after that jurisdictional boundary is reached: responsibility may become fragmented, institutional routing may remain unclear, and no single authority may retain operational ownership of the unresolved protection concern.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Developed within the Governance Integrity Architecture (GIA), the brief distinguishes legal competence from continuing governance responsibility. <strong>It identifies five interconnected institutional risks:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the Competence Gap;<\/li>\n\n\n\n<li>the Responsibility Gap;<\/li>\n\n\n\n<li>the Routing Gap;<\/li>\n\n\n\n<li>the Continuity Gap; and<\/li>\n\n\n\n<li>the Traceability Gap.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Together, these gaps may leave affected persons without a clear and operational pathway to accountability, even where administrative, judicial, parliamentary and supervisory remedies formally exist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The brief examines how procedural closure, fragmented institutional mandates and ineffective referral mechanisms may interrupt responsibility without resolving the underlying protection concern. Particular attention is given to high-consequence cases involving third States, prolonged institutional delay and risks that become increasingly difficult to reverse over time.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>To address these deficiencies, the brief proposes a policy framework centred on:<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>continuous institutional ownership;<\/li>\n\n\n\n<li>structured competence transfer;<\/li>\n\n\n\n<li>identifiable national accountability entry points;<\/li>\n\n\n\n<li>mandatory escalation in prolonged and high-consequence cases;<\/li>\n\n\n\n<li>traceable decision and referral records; and<\/li>\n\n\n\n<li>documented continuity of responsibility following jurisdictional or procedural closure.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>It establishes the following Governance Integrity Standard:<\/strong><\/h4>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">No jurisdictional exclusion, institutional referral or procedural closure should be considered complete until responsibility has been identified, documented, accepted or formally transferred through a reviewable process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By shifting the policy question from \u201cWho has legal competence?\u201d to \u201cWho remains responsible when competence ends?\u201d, this work advances an operational governance model for EU accountability, consular protection, cross-border child protection, public administration and administrative law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It offers practical reforms for strengthening accountability across the EU\u2013national interface and ensuring that jurisdictional boundaries do not become accountability voids.<\/p>\n<\/blockquote>\n\n\n\n<h4 class=\"wp-block-heading has-small-font-size\"><strong>#Protection fails when activation comes after effect<br>#Protection delayed is protection denied<\/strong><\/h4>\n\n\n\n<h4 class=\"wp-block-heading has-text-align-center has-vivid-red-color has-text-color has-link-color wp-elements-2c2f824633070089ccd1e6018c68471f\"><strong><em>\u00ab<\/em>A jurisdictional boundary may determine where EU competence ends.
