Submitted to the Advisory Committee of the United Nations Human Rights Council<\/strong><\/strong><\/em><\/h2>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>ABSTRACT: The evolving legal enforcement of economic, social and cultural rights (ESCR)<\/strong><\/h4>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">This contribution examines the evolving legal enforcement of economic, social and cultural rights (ESCR), arguing that the principal challenge has shifted from the recognition of these rights to their practical effectiveness. While international and regional legal frameworks \u2013 including the International Covenant on Economic, Social and Cultural Rights (ICESCR), the European Convention on Human Rights (ECHR), and the Charter of Fundamental Rights of the European Union \u2013 have strengthened the justiciability of ESCR and expanded access to remedies, a persistent structural gap remains between formal legal recognition and effective implementation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The paper identifies recurring obstacles that undermine effective protection, including delayed judicial intervention, post-factum remedies, fragmented institutional responses, and coordination failures, particularly in cross-border contexts. It argues that the temporal dimension of legal protection has been insufficiently examined. Existing legal systems tend to assess whether rights are recognised and remedies exist, but pay less attention to whether protective mechanisms are activated in time to prevent irreversible harm. Consequently, legal protection may satisfy formal requirements while failing to achieve its substantive purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The contribution contends that meaningful enforcement of ESCR requires evaluating not only legal entitlement but also the operational capacity of legal and institutional systems to provide timely protection. It concludes that justiciability alone is insufficient unless accompanied by structural safeguards capable of ensuring preventive, rather than merely reactive, protection. When international child-abduction disputes are effectively transformed into domestic custody proceedings, the effectiveness of the Hague Convention is diminished, jurisdictional safeguards risk being displaced, factual situations become progressively entrenched through the passage of time, and children may suffer irreversible harm before the Convention&#8217;s protective mechanisms are meaningfully engaged.
