It was 28\/08\/2017 when I took a message from my wife, writing to me. \u201cwe won\u2019t come back to Greece, don\u2019t go tomorrow to the airport to pick us up, we will stay in Russia\u201d. My whole world, as I knew it, lived it, and learned it in school and in my family, changed rapidly into a Hell. George is a victim of international child abduction in the Russian Territory.<\/p>\n\n\n\n

Several court procedures have run in Russia, and all have failed to protect even access to our lovely kid Georgios Trakas. George and his father are victims of national and male discrimination by Russian institutions. All were organized and ordered by two psychopaths M.Subbotina & L. Subbotina. Until now, George, born on 11\/09\/2013 in Greece, is prohibited from traveling outside of Russia (travel ban) and from having any unsupervised contact with his father and all his Greek relatives. He has been denied even the right to learn his mother language (Greek). His personal photos and life are usually shared on Facebook by a mentally ill and narcissistic mother.<\/p>\n\n\n\n

We ask for the respect of human rights (right to a family, right to the language, right to a private life) of both father and son. George, we do not forget you. We love you, and we will wait for you as far can take. <\/p>\n<\/blockquote>\n\n\n\n

REPORT ON HUMAN RIGHTS VIOLATIONS OF GREEK CITIZENS IN THE RUSSIAN TERRITORY<\/h3>\n\n\n\n

I present to you the serial and human rights violations of me and my child in Russian territory. My name is Dimitrios Trakas, and I am a resident of the community of Agio Pnevma of Serres. My son Trakas Georgios was abducted on 29\/08\/2017 in Dubna City by his mother. The child has been staying in Russia illegally since that day. Below I date you to the violations of the 1950 European Convention on Human Rights.<\/p>\n\n\n\n

10\/01\/2018: Victim of physical violence by two Russian citizens. With the help of my Russian lawyers, I filed a complaint with the local police, with the prosecutor dismissing my case and referring it to the file. A forensic report on the signs of the attack on me was also submitted. Violation of Article 6 (right to a fair trial).<\/p>\n\n\n\n

02\/14\/2018: Public exhibition of two Greek citizens on a TV channel. Public display of moments and images of Son and Father without altering their face. George Trakas, on camera, witnessed a verbal hate attack against his father and Greece in general. The bad Greeks who make children to live with the social benefits of the state. Violation of Article 8. (Right to respect for private and family life). Violation of Article 14. (Prohibition against discrimination)<\/p>\n\n\n\n

14\/03\/2018: Trial in the Tverskoy district court of Moscow of the application for the return of the minor to Greece No. 33-30022 \/ 2018 through the procedure of the convention of The Hague 1980 for the protection of the rights of the child against parental abductions of minors. Refusal to return, an alibi used that allegedly only in Russia can the minor have medical care that specializes in his developmental course to improve the development of his speech. Violation of Article 8. (Right to respect for private and family life). Violation of Article 14. (Prohibition against discrimination). Terms of trial as described below: The time the judge gave to decide on the future of a child\u2019s soul was just 10 minutes after the hearing. The room was less than 50 sqm. I had no place next to my lawyers. There was no room even for the representatives of the Greek Consulate. There were no toilets available to the public, and disabled people had access to the court halls. Records of our trial were handed over only on the last day of the appeal period. Violation of Article 6 (right to a fair trial).<\/p>\n\n\n\n

10\/07\/2018: Trial of the appeal in Moscow City court case number No 33-30022 \/ 2018. Second refusal to return the child to Greece. Violation of Article 8. (Right to respect for private and family life). The case goes to the State Legal Council and then to the European Court of Human Rights.<\/p>\n\n\n\n

23\/11\/2018: Trial in the Tverskoy district court of Moscow again, second Greek request through the contract of The Hague 1980 for protection and determination of communication of the minor with the Greek father, case No 33-37565 \/ 2018. This time in a new building of high standards. But the crime ended in the harshest way. A Greek father demands protection of his communication with his child, and in response to the court, he receives a ban on the child\u2019s exit from the country, no overnight stay with his child, no private time between father and son, and no participation in a Greek school. Violation of Article 8. (Right to respect for private and family life). An official alibi used this time as well, that the alleged abstention from his medical visits to a speech therapist, even for a few days in Greece, would leave him behind in his treatment. It has been argued in court that learning Greek does not help a 5-year-old minor improve his speech. Violation of Article 14. (Prohibition against discrimination).<\/p>\n<\/blockquote>\n\n\n\n

On September 15, 1990, the \u201cConvention on the Rights of the Child\u201d came into
force for the Russian Federation, approved by the UN General Assembly on
November 20, 1989.
Subject to the provisions of the Convention, the Russian Federation has published
its own laws in relation to children: \u00abThe Family Code of the Russian Federation\u00bb,
\u00abOn Basic Guarantees of the Rights of the Child in the Russian Federation\u00bb, \u00abOn
Education in the Russian Federation\u00bb, as well as other legal acts guaranteeing
children respect their rights and legitimate interests.
The Russian Federation, as a country signatory to the \u201cConvention on the Rights of
the Child\u201d, as well as having issued national laws regarding the protection of the
rights and legitimate interests of children, has undertaken a guarantee and a
commitment to implement them.
The implementation of these laws was delegated to various branches of the
executive branch *, by endowing them with relevant powers, obliging them to
comply with all (without exception) this legislation, to protect all (without
exception) rights and legitimate interests of the child.
Moreover, in reality, in the Russian Federation, there is a situation where
everything guaranteed by law, the rights and legitimate interests of the child, are
violated for years, everywhere, and systematically.
Since this appeal is of a collective nature, I do not consider it possible to dwell on
the violated rights of my particular child **, but when communicating with the
rest, the parents who signed, there is a widespread and systematic violation of the
following articles of the \u201cConvention\u201d: Art. 2, 3, 4, 5, 7, 8, 9, 12, 16, 18, 19, 24,
27, 31, 37, 39, 42. ***
Often, the rights of children are violated precisely by the bodies called upon to
protect them, and the entire obligation of the law to protect them is actually
reduced to endless correspondence in accordance with Federal Law No. 59 \u201cOn
citizens\u2019 appeals\u201d or to the transfer of information about violations to \u201cadjacent\u201d
bodies authorities. In the best case, the fact of violations is recorded, but they do
not take any effective measures to stop and prevent these violations.
The ubiquitous appeals of the Parents to the guardianship authorities, the
Commissioner for the Rights of the Child, the structure of the Ministry of Internal
Affairs and the prosecution authorities \u2013 do not give any effective results.
Violations or omissions of some organs \u2013 are covered by others. As a result, current
situations are not resolved for years. The actual lack of responsibility for the
violations and\/or inaction of the authorities \u2013 only provokes subsequent
violations.
A similar situation occurs in the courts: very often, unlawful decisions are made,
based only on the \u201cinternal conviction of the judge\u201d while fundamentally
contradicting both the current legislation and the interests of the child. All the
postulates prescribed in the Convention, the Family Code, and other legal acts are
ignored by the courts.
Given the above-described situation of inoperability and inaction of the existing
the system, the importance and priority of the interests of children in terms of the
interests of society and the state protected by law, as well as the obligations
undertaken by the Russian Federation and guaranteed to citizens by the
Constitution of the Russian Federation,<\/p>\n\n\n\n
