ABSTRACT

The letter to the Swedish Ministry for Foreign Affairs follows the Ministry’s failure, under the authority of Minister Maria Malmer Stenergard, to provide a substantive response within the 21-day deadline specified in a formal submission dated 22 April 2026. That submission set out five demands concerning the continued unlawful retention of two Swedish minor nationals in Belarus, notwithstanding a binding Swedish sole custody judgment and nine years of documented diplomatic inaction.

The case raises serious questions regarding Sweden’s compliance with obligations under the Hague Conference framework, the United Nations Convention on the Rights of the Child, and the Vienna Convention on Consular Relations. The absence of any ministerial response is presented not merely as administrative silence, but as evidence of a continuing failure to provide effective State protection, consular assistance, and legal remedy.

Anthie, aged thirteen, and Alexandra, aged eleven, have spent nine years and the entirety of their conscious lives, respectively, in institutional confinement in a foreign State contrary to a Swedish court order. During this period, no documented independent consular access, formal diplomatic protest, or inter-state recovery mechanism has been initiated on their behalf. The case raises fundamental concerns regarding State accountability, child protection, and the rule of law.

The forensic record is complete. The legal obligations are clear. The political will to fulfil them is the sole variable that remains unresolved.
